TERMS AND CONDITIONS FOR WEBSITE SALE OF TYRES AND TYRE FITTING SERVICES

Our terms and conditions apply to all online conditions of sale from our web site.
The terms are set out below.
Read them before ordering.
You may wish to print a copy for future reference.
Other terms and conditions such our privacy policy should also be read as part of this agreement.
We may change these terms from time to time without notice to you.
Changes will apply to any subsequent orders recieved.
We reserve the right to change these terms from time to time.
Changes will be posted on this site.

This website is an invitation to treat, and nothing on this website shall be construed as a unilateral offer by TYRExpress.com Ltd to enter into any contractual obligations.
It is the customer’s responsibility to ensure that any tyres purchased are suitable for the customer’s vehicle and or their intended use.
TYRExpress.com Ltd cannot be considered liable for any recommendation made by any third party, or other external source of information, or by TYRExpress.com Ltd personnel, unless confirmed in writing by TYRExpress.com Ltd.
Goods are subject to availability and if we cannot supply them we will inform you and you will be given a full refund of what you have paid.
The goods are sold at the price on our web site at the date we receive the order from you.
If we find a pricing error on our web site we will inform you as soon as possible and give you the opportunity, if you wish, of reconfirming your order at the correct price or cancelling it.
If we cannot contact you, we will cancel the order.
If you cancel and you have paid for the goods, you will be given a full refund.

The order confirmation sets out the basis upon by which TYRExpress.com Ltd agrees to accept an order.
It is the customer’s responsibility to ensure that the order confirmation corresponds with the customers own expectations. Any discrepancy should be reported immediately to TYRExpress.com Ltd.

Payment must be received within seven days of order, and in any event before goods are despatched.
Title to goods remains with TYRExpress.com Ltd until paid for in full.
Responsibility for goods passes on delivery and/or fitting dependant on the purchase type/service selected by the Customer.
In the event that TYRExpress.com Ltd is unable to fulfil the order, it will be entitled to cancel the order.
In such instances any liability will be limited to refunding the customer for all payments received.
Goods will be delivered to either the address provided by the customer or to the fitting centre selected by the customer.
It is the customer’s responsibility to provide adequate information for the carrier to locate the address.
The customer agrees to indemnify TYRExpress.com Ltd against any costs that it may incur as a result of non-delivery due to inaccurate or inadequate instructions. In the event of such non-delivery TYRExpress.com Ltd reserves the right to dispose of the tyres, and seek compensation in respect of any resulting costs or losses.

Confirmation of delivery from the carrier will be presumed to constitute conclusive proof of delivery.
TYRExpress.com Ltd shall not be considered liable in respect of any defect arising from fair wear and tear, wilful damage, negligence or abnormal working conditions (including sport or track use).

The parties agree that, in the unlikely event of any defect arising in the tyres, the tyres will be submitted for adjudication by the manufacturer as to the cause of failure and their decision will be final.

Where the Consumer Protection (Distance Selling) Regulations 2000 apply, the customer may cancel the contract within seven days of the goods being delivered and receive a full refund, provided that the goods have not been fitted or used, and are in the same condition as when supplied.
In such instances it is the customer’s responsibility to pay for and arrange for the return of the goods, and to keep TYRExpress.com Ltd indemnified against all such costs.

In all circumstances the Customer must advise TYRExpress.com Ltd, in writing of the intended return of the goods, no returns will be accepted without prior written notification, notification that TYRExpress.com Ltd has acknowledged and agreed to.
Cancellation will only be accepted at the discretion of TYRExpress.com Ltd, and subject to payment of all reasonably resulting costs and/or losses.
Delivery and fitting dates are provided for guidance only, and cannot be guaranteed.
TYRExpress.com Ltd cannot be held liable for any delay in delivery and/or fitting.
Customers are advised to check directly with the fitting centre for suitable times and dates for fitting.
These terms and conditions govern the entire contract between TYRExpress.com Ltd and the customer.
All other rights are excluded to the maximum extent permitted by law.
Should any of these terms and conditions be held to be unenforceable in whole, or in part, then the remainder will remain valid.
This contract is governed by the prevailing law in England & Wales and any disputes will be resolved exclusively in the Courts of England & Wales.
